Terms and conditions of use and service

CONDITIONS OF SERVICE CONTRACT AND ACCESS TO THE EasyStay AREA.

The following are the general terms and conditions for the sale of rental accommodation service in pre-assembled tents and other types of accommodations, as well as access to the premises of the EasyStay Zone, for each of the events or festivals in which this area is enabled and for which this service is specifically agreed upon.

The organizer of the EasyStay Zone is EasyStay by Alessandra Fuoco based in Giornico. Registered on 12/05/2023 in the Commercial Register of the Canton of Ticino, CHE-330,426,635.

The mere purchase of the tent or other type of accommodation or invitation to accommodation in the EasyStay Zone, in any of its modalities, entails the automatic and unconditional acceptance of the following general conditions relating to the sale of the service accommodation in pre-sale rental mounted tents and other types of accommodation stores and access to the EasyStay Zone (hereinafter, “General Conditions”):

1.- BOOKING CONDITIONS

1.1.- Reservation of one of our tents or other accommodations entitles you to the use and enjoyment of them and related property, in accordance with the opening and closing conditions of the EasyStay Zone appearing in the confirmation e-mail.

1.2.- Payment is per tent or type of accommodation (goods included). Payment of theprice of the store or other accommodation will be made in one lump sum, in a lump sum, regardless of the number of occupants who will have access to it, and which can never exceed the maximum number of people established on EasyStay website for each type of tent.

1.3.- The price for the use and enjoyment of the tent or accommodation includes only those goods and services referred to in the description of the same established on the EasyStay website for each of the festivals or events.

1.4.- The payment that will be made will be exclusively for the use and enjoyment of ‘accommodation and property, not granting in any case to the reservation holder or occupants of the accommodation any right of purchase on the same.

1.5.- The occupants of the ‘accommodation must vacate and abandon them, as well as hand over all their belongings, on the day and at the time stipulated in the booking confirmation e-mail and, in any case, before the closing of the EasyStay Zone.

1.6.- All Assets made available to the occupants of the Tent or Lodging shall be guarded during use with due diligence, avoiding damage or deterioration to them beyond those of their normal use. All occupants of the Tent or Lodging are jointly and severally liable with the reservation holder for any damage done to them.

1.7.- The choice of the location of the Store will be at the discretion of EasyStay, according to its own criteria.

1.8.- The reservation holder shall submit in cash a deposit ranging from FIFTY to ONE HUNDRED FRANKS to cover any damages that may occur, committing to pay the difference in case, products, had a cost higher than the amount of the deposit. It will be made delivery the deposit during check out, upon verbal communication to the reservation holder, or failing that, the occupants if in case the holder is not an occupant. If the tent or accommodation is seriously damaged, the reservation holder will pay for its repair or replacement in full, an amount not fully covered by the required deposit.

1.9.- The reservation price does not include the daily cleaning of the inside of the tents or the change of bedding. In case the customer is interested in obtaining these services, he/she must apply for them by paying the cost of the services at the same time.

1.10.- EasyStay is not responsible, in any case, for items left in the tents or accommodations or in the Area adjacent to them, although the EasyStay Zone is equipped with fenced and secured spaces for the surveillance of objects and persons.

2.- E-MAIL CONFIRMING BOOKING AND ACCESS TO THE EasyStay AREA.

It is important to read well the contents of the e-mail confirming the reservation of accommodation and the rights, obligations and services it incorporates, since after it is acquired, they cannot be changed, except as stipulated in Clause 5 and Section 5 of Clause 2.

2.1.- The e-mail confirming the reservation of accommodation is configured as a named title, for the configuration of which, at the time of purchase, the customer’s personal data will be requested, which will be recorded in our Customer Database to keep him/her informed of the service contract and promote our services.

2.2.- The reservation confirmation e-mail includes an order number identifying the reservation. EasyStay SNC is not responsible for the use of this identifier or reservation code by a person other than the person who appears on the document as the purchaser and/or that it is forged, duplicated, or photocopied.

2.3.- After receiving the confirmation e-mail, the link to check in at the booked accommodation will be sent, again by e-mail. This check in, once filled in with all occupants’ data, day and time of arrival to the EasyStay Zone, must be printed and shown to the EasyStay Zone Reception, together with a valid ID (ID card, Passport…) . This document will be requested from each of the occupants of the accommodation who appear on the check-in sheet.

2.4.- The reservation will be valid only if acquired through the EasyStay platform (www.easystaswiss.ch).

2.5.- Accommodation reservation will always be for all days of the festival or event for which it has been reserved. The booking confirmation e-mail will report the opening and closing period of the EasyStay Zone, noting that:

The schedules referred to in this section may be changed by EasyStay if necessary, the new schedule being duly communicated on EasyStay’s Web site, by notice by mail, or through any of EasyStay’s communication channels.

2.6.- Specific features of booking accommodation with access to the EasyStay zone:

1. Access to the EasyStay area is reserved exclusively for participants in the Festival or Event for which it has been reserved. To gain access, one must have a Festival or Event ticket in addition to having purchased accommodation on the platform: www.easystayswiss.ch.

2. In some cases, if the Festival or Event requires it on its website, a camping or staging area access fee will be charged for access to the EasyStay area or required camping or staging area access. This requirement will be determined for each of the cases and will appear on both the Festival website and www.easystayswiss.ch.

Regarding this point, EasyStay SNC will be solely responsible for the inclusion of such information on its website, in connection with the content of the Festival or event that requires it.

2.7- Cancellation policy for reservations or orders:

1. The buyer may exercise the right of withdrawal for a period of up to 14 calendar days from the date the order was acquired or the date the reservation was made, provided it was made at least 30 calendar days prior to the start date of the event.

2. After this period, the amount of the order cannot be returned, the acquisition of the same being firm and unconditional.

3. In order to make his right of withdrawal effective, the purchaser, within the specified time limit, must send a registered letter or a reliable document to EasyStay SNC at the address indicated in these Conditions, or an email to info@easystayswiss.ch, confirming the wish to exercise this right of withdrawal, as well as receipt of paymentor proof of the reservation made, indicating exactly the date on which it was made.

2.8.- To enjoy its full effectiveness and incorporated rights, the check-in document must be complete and in proper condition.

2.9.- The check-in document has several security measures to ensure its authenticity.

2.10.- The organization is not responsible for reservations or orders that have not been purchased at official outlets.

2.11.- Any modified check-in document, or one with indications of forgery or alteration, will allow EasyStay to deprive its bearer of access to the EasyStay area, without prejudice to the right to take appropriate legal action against the alleged counterfeiter or counterfeiters of the tickets.

2.12.- Booking the accommodation does not authorize its owner or any third party to use it, or its contents, for advertising, marketing or promotional purposes (including, but not limited to, contests, gifts and/or sweepstakes) associated with the ticket holder or any third party. Failure to comply with this point will oblige the advertiser and/or unauthorized user to compensate the organization for the amount of damages caused. In such cases the reservation will be cancelled immediately.

2.13.- EasyStay will deliver invitation tickets -called Passes- .

3.- RESERVATION WITHDRAWAL AND BRACELET EXCHANGE

3.1.- Reservation must be exchanged for a wristband upon arrival in the EasyStay area at the EasyStay front desk and store assignment to the first occupant who checks in. The front desk at EasyStay is open 24 hours a day from the time the EasyStay area opens until the time it closes (dates and times appearing in the booking confirmation e-mail).

3.2.- Once this reservation has been exchanged for the wristband at the EasyStay front desk, the wristband becomes the item that certifies the right to access and stay and must be kept on the wrist during all days of the Festival or Event.

3.3.- Loss of the wristband will result in the loss of the right to enter and/or stay in the EasyStay area and, therefore, the booked accommodation.

3.4.- The organization warns that open, manipulated, damaged or broken wristbands will not be accepted.

3.5.- To temporarily leave the EasyStay area and re-enter, you will need to keep your wristband during all days of the Festival or Event.

3.6.- Only people who appear correctly on the check-in sheet can redeem the wristband. When a reservation is to be exchanged by several people or occupants, all of them, jointly, must show it together with their IDs or passports at the EasyStay area reception desk.

3.7.- In case of access of minors to the EasyStay area, in addition to the above requirements, the specifications of the right of admission of minors determined by the organization of the Festival or Event in question shall be followed on its website.

4.- SUSPENSION OR CANCELLATION OF THE FESTIVAL OR EVENT FOR WHICH EasyStay HAS BEEN RESERVED AND CASES OF “NO SHOW” DUE TO CAUSES OF FORCE MAJEURE BY CUSTOMER.

4.1.- Suspension, cancellation or modification of the Festival will not result in a refund of the amount of the accommodation reservation when it occurs once the Festival or Event has begun and that the cancellation, suspension or modification in question is due to force majeure.

4.2.- Cancellation, in whole or in part, of the Festival or Event due to weather contingencies caused by rain or other adverse weather events will not result in a refund of the amount of the accommodation reservation.

4.3.- In order to guarantee the customer’s reservation, in the event of cancellation of the Festival due to force majeure, EasyStay will proceed, upon the customer’s request within the established period and duly informed on the EasyStay website itself, to refund the amount of the reservation or offer the customer a reservation equivalent to the original reservation for a new date determined by the organizer of the Festival or Event or for the next edition of the Festival or Event, or even for another event managed by EasyStay.

4.4.-In the event of a “no show” by the customer in the EasyStay area, due to inability to service due to justified force majeure, EsyStay applies the same guarantee as in 4.3

4.5.- Notwithstanding the foregoing, EasyStay, in the event of cancellation, suspension, or modification of the Festival or Event, in no event shall EasyStay be responsible for any costs that are borne by the participant, such as travel, transportation, food, or beverages, among others.

4.6.-In relation to return processes caused by the cancellation or change of dates due to COVID-19, on an extraordinary basis, we stick to the return deadlines set by festivals, with the aim of providing a longer period for those customers who wish to send us any requests. This request should be sent directly to EasyStay by the reservation holder

5.- CHANGE OF TICKET HOLDER

5.1.- The reservation holder cannot be changed, the payment for the reservation being associated with it, but you can give your tent to a third party by entering their details on the check in sheet. In case this form is already filled out with the owner’s data, the owner should write an email (from the email left at the time of booking) to EasyStay (info@easystayswiss.ch) requesting this change. Once the new check-in document is generated, the third party to whom the accommodation has been transferred will be able to access the EasyStay zone and enjoy the reserved accommodation.

5.2.- This change of name of the occupants of the tent or accommodation can never be requested or done if the physical check-in has already been done in the EasyStay area.

6. RIGHT OF ADMISSION

6.1.- EasyStay reserves the right of admission to the EasyStay zone.

6.2.- EasyStay adheres to the rules for the access and stay of minors in the EasyStay area that each Festival or Event establishes in its camping regulations placed in the event website. In any case, the consumption of alcohol and tobacco to minors under 18 years of age is prohibited, and the minor may be expelled, and accompanying person if applicable, who violates these prohibitions, without generating any right to a refund of the amount of the ticket paid by the minor and, in the case of a minor under 16 years of age, by the accompanying person.

6.3.- For access to the EasyStay area, the public may be registered at the entrance, not allowing the introduction of objects that may be considered dangerous by the Festival or Event organization (provided for in the camping regulations) or by the EasyStay itself, or are prohibited by current regulations.

6.4.- For safety reasons, any type of motor vehicle is prohibited from entering the EasyStay area.

6.5.- EasyStay may prevent access or eject from the premises those who: (i) may cause or have caused situations of risk, danger, fights, disturbances or similar behavior; (ii) may hinder or have hindered the normal course of coexistence in the EasyStay zone (iii) transporting drugs or being at the discretion of the organization in states of apparent or potential intoxication; and, in any case, (iv) carry any object that the organization deems dangerous in the EasyStay zone environment (pyrotechnic articles, weapons, bottles, glass objects, laser pointers, etc.,…); or (v) fail to follow the instructions given at all times by EasyStay, those set forth in these General Conditions and/or the Festival Camp or Event Rules.

6.6.- EasyStay in none of the above cases will refund the amount paid to those who have been denied access or who have been expelled from any Festival venue.

7. INTELLECTUAL PROPERTY RIGHTS AND IMAGE, VOICE AND NAME

The occupant of the accommodation who appears as such on the check in document or the EasyStay wristband holder who accesses the EasyStay area, expressly and unequivocally consents and authorizes that his or her image and voice may be fixed on media during the celebration of the festival or event and thereafter may be disseminated by EasyStay or authorized third parties in any media for promotional and/or commercial dissemination of EasyStay.

In the case of minors, the acquisition of the ticket or the access of accompanied minors, together with the mandatory authorization entails, by the legal guardians, the authorization for the recording and broadcasting of the image and voice of the minors referred to in the preceding paragraph.

8. LEGAL RESERVE.

EasyStay SNC shall have the right to take such legal measures, both civil and criminal, as it deems appropriate against the causes of any attempted fraud, trespass and/or damage caused to the organization, directly or indirectly. Legal notice and terms of use and privacy and cookie policy
